TERMS OF SERVICE

The following are the terms and conditions for use of PrivacyHarbor.com private email including present and future features offered by PrivacyHarbor® and other services, which may be offered from time to time by PrivacyHarbor, Inc. for use with your PrivacyHarbor.com account (each feature individually and collectively referred to as the "Service"). Please read them carefully. This Service is provided to individuals who are at least 18 years old or to minors who have parental consent to open and maintain an account.

Each user is solely responsible for his or her transmissions through PrivacyHarbor.com.

As a condition of your use of the Service, you affirm to PrivacyHarbor®, that you will not use the Service for any purpose that is unlawful or prohibited by these terms, conditions, and notices. Any unauthorized commercial use of the Service, or the resale of its services, is expressly prohibited.

By registering an account with PrivacyHarbor®, you agree to be bound by the terms outlined in this Service Agreement. PrivacyHarbor® may, at its sole discretion, immediately terminate service without cause or notice should user's conduct fail to conform to these conditions.

1. We're an Internet-based business and we use the Internet to send and receive certain types of communications. You agree to be bound by Internet regulations, policies and procedures.
2. You agree to comply with all applicable local, state, national and international laws and regulations. You also agree to not use your PrivacyHarbor.com account for illegal purposes, to not interfere or disrupt computers or networks connected to this service, and to comply with all the rules, policies and procedures connected to this service.
3. You will not use your PrivacyHarbor.com account to send junk email, unsolicited bulk email (commonly referred to as spam), chain letters or use email lists that contain any person that has not specifically agreed to be included on that list.
4. You will not transmit or allow others to use your email account to transmit through PrivacyHarbor, any objectionable material including, but not limited to unlawful or harassing, libelous, abusive, threatening, harmful, vulgar or obscene material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate items discussed in #2 above.
5. You will not use your PrivacyHarbor account or email address to transmit or facilitate the transmission of malware including but not limited to viruses, Trojan horse programs, worms, key- loggers, attack software or any similar software.
6. You agree to not interfere with another member's use and enjoyment of PrivacyHarbor or any other similar service.
7. You agree not to harvest or otherwise collect information about others, including email addresses, without their consent.
8. You will not create a false identity for the purpose of misleading others as to the identity of the sender or the origin of a message.
9. You will not allow others to use your PrivacyHarbor account or email address to violate any of these terms of service.

NO OBLIGATION, 1 MONTH FREE TRIAL

All new subscribers will receive a no obligation, 1 month free trial period, applicable to any private email account type. Subscribers of any account type can cancel within the first month of a new registration without paying for the service. You may cancel your account by contacting us via private message in your account, or by phone.

CONDITIONS

• Once your billing begins, you may cancel any account type by contacting customer support via email at support@privacyharbor.com, via phone at 360.906.8111 at least 15 days prior to the end of your account subscription. (Note: After your billing begins, there are no refunds for monthly, yearly, or lifetime subscription payments or additional storage purchased prior to canceling the account.) Please indicate if you wish to cancel your account or just switch to a free PrivacyHarbor.com Basic Account. We will send you an email confirmation that your account status has been changed.
• Phone cancellation must be before 5pm PST in order to count as canceling on that day.
• Private message cancellations must be sent before 12am PST in order to count as canceling on that day.

SPAM POLICY

Our spam policy at PrivacyHarbor® is "zero-tolerance". Anyone found to be generating spam from within our system will have their user privileges revoked immediately. Persons attempting to forward spam email messages inbound to our system will be blocked and prevented from sending further email to any PrivacyHarbor® users.

Please note, however, that many messages appearing to originate from PrivacyHarbor.com (or any other) mail servers could contain "forged headers", written by the party originating the messages to make them appear to come from somebody else. This is done to avoid action normally taken against those abusing email systems and to cause damage to the reputation of the parties appearing to have sent the messages. Experienced investigators can tell immediately whether headers have been forged and where the message actually originated; thus, it is important that any mail forwarded to us for investigation contains the complete headers from the original message.

ACCOUNT TERMINATION

PrivacyHarbor® may terminate your access to the Service and any related service(s) at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever. PrivacyHarbor® has no obligation to store or forward the contents of your account.

ACCOUNT SECURITY

You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. If you believe your account has been tampered with, please contact us immediately.

LIABILITY

The information and services included in or available through the Service may include inaccuracies or errors. PrivacyHarbor® may make improvements and/or changes to the Service at any time without notice.

PrivacyHarbor® guarantees that if for any reason you are unsatisfied with the service, you may cancel within the first month.

PrivacyHarbor® does NOT guarantee that PrivacyHarbor.com will be uninterrupted or error-free, or that bugs or malfunctions with your particular system will be corrected. PrivacyHarbor® provides its Service "as is". The Company makes no warranty or covenant in regards to the availability, reliability, or timeliness of the Service. PrivacyHarbor® is not responsible for the appropriateness of the Service for any one purpose.

PrivacyHarbor® will not be held responsible for any and all damages whatsoever as a result of the loss of use, data or profits connected to the performance of PrivacyHarbor.com. The user is solely responsible for any and all information that passes through the PrivacyHarbor® servers. PrivacyHarbor® is not responsible or liable for any product or service acquired or requested using the Service. The sole remedy is for users to discontinue their use of PrivacyHarbor®.

INDEMNIFICATION

You agree that PrivacyHarbor®, its parents, subsidiaries, officers and employees, cannot be held responsible for any third party claim, demand, or damage, including reasonable attorneys' fees, arising out of your use of the Service.

MESSAGE STORAGE, SENDING MESSAGES AND MESSAGING LIMITATIONS

The amount of email storage space per member is limited; please visit our Feature Comparison page for more information. Some email messages may not be processed due to space constraints or outbound message limitations. You agree that PrivacyHarbor® is not responsible or liable for the deletion or failure to store messages or
other information.

You (the user) are responsible to make sure your message recipients are willing to cooperate in maintaining conversation privacy. Whereas SMTP email travels unprotected through multiple servers, private messages follow a secure pathway (SSL) from your account to the account of the recipient. However, since the Service cannot prevent your recipients from circumventing security measures, PrivacyHarbor® is not responsible or liable for exposure of your messages caused by recipients failing to keep your conversation private. To help prevent exposure, make sure your contacts are willing to keep confidentiality, and have secured their machines with virus protection and a firewall.

Messages sent as "common email" have no implication of privacy whatsoever. The send as "common email" function is included for recipients that are unable or unwilling to view private messages. Messages sent as "common email" may be subject to keyword harvesting or other intrusions as soon as they are sent from your account.

THIRD PARTY SITES

The links included within this website may allow you leave the PrivacyHarbor.com and visit third party websites. These third party sites are not under the control of PrivacyHarbor®. PrivacyHarbor® is not responsible for the contents of any third party site nor is PrivacyHarbor® responsible for the functionality of any third party site. PrivacyHarbor® provides links to our service to you strictly as a convenience. A links inclusion in a PrivacyHarbor® site does not endorse the site or their operators.

Any promotions sponsored by Advertisers at such sites are solely between you and that third party. PrivacyHarbor® is not responsible in any part of any such connections or dealing with advertisers or their promotions.

MODIFICATIONS TO TERMS OF SERVICE, MEMBER POLICIES

PrivacyHarbor® reserves the right to review and change this agreement regarding the use of the Service at any time and to notify you by posting an updated version of the agreement on this website. You are responsible for regularly reviewing PrivacyHarbor® policies. Continued use of the Service after any such changes shall constitute your consent to such changes. Any rights not expressly granted herein are reserved.
